Atlas of the 4 Slovak Heir Classes (§ 473 – § 475a CC)

1st Class: Children and Spouse (§ 473 Civil Code)

Inherit in equal shares. If a child does not inherit, their share passes equally to their children (grandchildren).

Condition: The spouse cannot inherit alone in the 1st class – if the decedent had no children, succession moves to the 2nd class.

Distribution: Equal shares (e.g. spouse + 2 children = 1/3 each).

2nd Class: Spouse, Parents and Cohabitants (§ 474 Civil Code)

Applies if the decedent had no descendants. The spouse always inherits at least one half (1/2) of the estate.

Condition: A cohabitant must have lived with the decedent in a common household for at least 1 year before death.

Distribution: Spouse min. 1/2, the rest equally among parents and cohabitants.

3rd Class: Siblings and Cohabitants (§ 475 Civil Code)

If neither spouse nor any parent inherits. If a sibling does not inherit, their share passes to their children (nephews and nieces).

Condition: Siblings and persons living in a common household for min. 1 year inherit in equal shares.

Distribution: Equal shares among all siblings and cohabitants.

4th Class: Grandparents and their children (§ 475a Civil Code)

If nobody in the 3rd class inherits. Grandparents inherit equally; if none of them, their children (uncles and aunts) inherit equally.

Condition: Last statutory class in Slovakia. If there is no heir here either, the estate escheats to the state.

Distribution: Equal shares among grandparents or their children.
